Governor Kathy Hochul (D) announced on May 7, 2026 that she plans to opt New York into the federal scholarship tax credit, making New York the largest Democratic-led state to signal participation. Her office said she will wait for the IRS to issue implementing regulations before submitting the formal election, so the opt-in is not yet final. New York has not filed IRS Form 15714.
